Pc-196 SUBROGATION AND SUBROGATION WAIVER CLAUSE
The Insurer shall be subrogated to the extent of any payment
hereunder to all the Insured’s rights of recovery therefore and the Insured
shall do nothing after the loss to prejudice
such right and shall not have the
rights to be subrogated to or to require assignment of the Insured’s Rights or
rights of recovery against :
Subsidiaries, associate companies, contractors or sub
contractors to whom the Insured prior to a loss, have waived the rights of
recovery.
Any of the Insured or their directors, officers, employees
or members of their families.
Any subsidiaries, associate companies, contractors or sub
contractors if such party could charge back to the insured the amount recovered
by the Insurers.
KLAUSUL SUBROGASI DAN PENGECUALIAN SUBROGASI
Penanggung akan disubrogasi hingga batas
pembayaran apa pun di bawah ini terhadap semua hak pemulihan Tertanggung dan
Tertanggung tidak boleh melakukan apa pun setelah kerugian tersebut untuk
merugikan hak tersebut dan tidak akan memiliki hak untuk disubrogasi atau untuk
meminta pengalihan Hak Tertanggung atau hak pemulihan terhadap:
Anak perusahaan, perusahaan asosiasi,
kontraktor atau subkontraktor tempat Tertanggung sebelum kerugian, telah
mengesampingkan hak pemulihan.
Setiap Tertanggung atau direktur, pejabat, karyawan
atau anggota keluarga mereka.
Setiap anak perusahaan, perusahaan asosiasi,
kontraktor atau subkontraktor jika pihak tersebut dapat menagih kembali kepada
tertanggung sejumlah yang dipulihkan oleh Penanggung
