 PC-215 VEHICLE LOAD CLAUSE

 

It is hereby agreed that in the event of the insured property being left loaded in vehicles or freight containers overnight while in, on or about the premises hereby insured, the Insurer will indemnify the Insured for the loss of or damage to such property caused by perils insured hereby. Provided always that the Insurer's Liability shall not exceed the sum insured of such property under the Policy.

Apabila harta benda milik Tertanggung dibiarkan dalam kendaraan atau peti kemas sepanjang malam selama berada di dalam, pada atau di sekeliling pekarangan yang dipertanggungkan, Penanggung akan memberikan ganti rugi kepada Tertanggung atas kerugian atau kerusakan pada harta benda tersebut yang disebabkan oleh kebakaran atau oleh risiko-risiko lainnya yang dipertanggungkan, dengan ketentuan, bahwa tanggung jawab Penanggung tidak akan melebihi jumlah pertanggungan dalam Polis atas harta benda dimaksud.

The Policy extends to include any loss incurred less the amount of any salvage monies obtained in respect of undamaged stock and/or materials in trade becoming unusable for any reason whatsoever resulting solely from an occurrence of loss or damage Insured by this Policy.

PC-071 DEPARTMENTAL CLAUSE In the same manufacturing concerns several product lines are manufactured or the factory may be, for accountancy purposes, split into several departments with various rates of gross profit applying. In such cases it may be more beneficial to deal with a claim on a department by department basis. In addition it is sometimes difficult to detect a reduction in turnover if one simply studies the overall results. The effect of an insured incident may be more noticeable on a department basis. This clause allows the claim to considered on this basis. It is worth noting however, that there is an argument that the adjustment clause which forms part of the standard policy already allows for this. After all we attempting to measure the loss as accurately as possible. KLAUSUL DEPARTEMEN Dalam perusahaan manufaktur yang sama, beberapa lini produk diproduksi atau pabrik mungkin, untuk tujuan akuntansi, dibagi menjadi beberapa departemen dengan berbagai tarif laba kotor yang berlaku. PC-061 CUT THROUGH CLAUSE The ceding company hereby agree that the reinsurers may pay directly to the insured, through the intermediary of the broker(s) hereunder, the amounts due in respect of any approved claim hereunder, provided that the following conditions are fulfilled : 1. The ceding company and reinsurers must have either (a) approved the claim or (b) required to make payment by court decision. 2. The ceding company does hereby give irrevocable instruction to the reinsurers to make direct payment of all approved losses occuring during policy period to the claimant, and it is hereby agreed that reinsurers’ payment to the claimant relieves it of any and all liability toward ceding company with respect to such quantum of the claim in question paid by reinsurers. 3. Before making a direct payment hereunder reinsurers shall have the right to deduct from such payment any overdue balance relating to this reinsurance owed by the ceding company to reinsurers. KLAUSUL PEMOTONGAN Perusahaan yang menyerahkan dengan ini setuju bahwa reasuransi dapat membayar langsung kepada tertanggung, melalui perantara pialang di bawah ini, sejumlah uang yang harus dibayarkan sehubungan dengan klaim yang disetujui di bawah ini, dengan ketentuan bahwa kondisi berikut terpenuhi: 1. Perusahaan yang menyerahkan dan reasuransi harus (a) menyetujui klaim atau (b) diharuskan melakukan pembayaran melalui keputusan pengadilan. 2. Perusahaan yang menyerahkan dengan ini memberikan instruksi yang tidak dapat dibatalkan kepada reasuransi untuk melakukan pembayaran langsung atas semua kerugian yang disetujui yang terjadi selama periode polis kepada penggugat, dan dengan ini disetujui bahwa pembayaran reasuransi kepada penggugat membebaskannya dari segala dan semua kewajiban terhadap perusahaan yang menyerahkan sehubungan dengan jumlah klaim yang dimaksud yang dibayarkan oleh reasuransi. 3. Sebelum melakukan pembayaran langsung di bawah ini, reasuransi berhak untuk memotong dari pembayaran tersebut setiap saldo terutang yang terkait dengan reasuransi ini yang terutang oleh perusahaan yang menyerahkan kepada reasuransi.
PC-047 COMPUTER SYSTEM AND OTHER RECORDS Computer systems records but only for the value of the materials together with the cost of clerical labour and computer time expended in reproducing such records (excluding any expense in connection with the production of information to be recorded therein) and not for the value to the Insured of the information contained therein. KLAUSUL SISTEM KOMPUTER DAN CATATAN LAINNYA Catatan sistem komputer, tetapi hanya untuk nilai bahan-bahannya bersama dengan biaya tenaga kerja administrasi dan waktu komputer yang dikeluarkan untuk mereproduksi catatan tersebut (tidak termasuk biaya apa pun yang berhubungan dengan produksi informasi yang akan dicatat di dalamnya) dan bukan untuk nilai bagi Tertanggung atas informasi yang terkandung di dalamnya.

ELECTRONIC DATA RECOGNITION CLAUSE (EDRC)

This Insurance does not cover any loss, damage, cost, claim or expense, whether preventative remedial or otherwise, directly or indirectly arising out of or relating to :
1.         the calculation, comparison, differentiation, sequencing or processing of data involving the date change to the year 2000, or any other date change including leap year calculations, by any computer system, hardware, program, or software and/or any microchip, integrated circuit similar device in computer equipment or non-computer equipment, whether the property of the insured or not, or
2.         any change, alteration, or modification involving the date change to the year 2000 or any other date change including leap year calculations, to any such computer system hardware, programme or software and/or any microchip, integrated circuit or similar device in computer equipment or non-computer equipment, whether the property of the insured or not.
This clause applies regardless of any other cause or event that contributes concurrently or in any sequence to the loss, damage, cost, claim or expense.

Asuransi ini tidak menjaminkerugian, kerusakan, biaya, klaim atau pengeluaran, baik untuk pemulihan pencegahan maupun langsung atau tidak langsung yang timbul dari atau terkait dengan:
1.         perhitungan, perbandingan, diferensiasi, sekuensing atau pengolahan data yang melibatkan perubahan tanggal pada tahun 2000, atau perubahan tanggal lainnya termasuk perhitungan tahun kabisat, oleh sistem komputer, perangkat keras, program, atau perangkat lunak dan / atau microchip apapun, rangkaian  Perangkat terpadu serupa pada peralatan komputer atau peralatan non komputer, baik milik tertanggung atau tidak, atau
2.         perubahan, perubahan, atau modifikasi yang melibatkan perubahan tanggal pada tahun 2000 atau perubahan tanggal lainnya termasuk perhitungan tahun kabisat, ke perangkat keras, program atau perangkat lunak sistem komputer dan / atau microchip, sirkuit terpadu atau perangkat serupa di komputer. peralatan atau peralatan non komputer, baik milik tertanggung atau tidak.

Klausul ini berlaku terlepas dari penyebab atau kejadian lain yang berkontribusi secara bersamaan atau dalam urutan apapun terhadap kerugian, kerusakan, biaya, klaim atau biaya.

UNPAID VENDOR COVERAGE / SELLER’S INTEREST CONTINGENCY CLAUSE


In respect of shipments which are sold by the Insured on terms other than Cost Insurance Freight, this policy shall be extended to cover the interest of the Insured as Unpaid Vendor until payment, but in no event beyond the time when Underwriters risk would normally cease under the terms of this insurance.

It is agreed that in no event shall this insurance inure to the benefit of the buyer or his Insurers, but in the event of loss or damage covered by this insurance, if the Insured is unable to collect payment recoverable from the buyer, Underwriters shall advance the amount of such loss pending collection from the buyer, and the Insured shall use all reasonable means to collect the full amount due from the buyer and reimburse Underwriters, the latter sharing the expense of such collection in proportion to their interest.

Warranted that the existence of this insurance shall not be disclosed to the buyer(s).

Warranted that this insurance shall not contribute to any claim on the buyer's insurance

UNSEAWORTHINESS AND UNFITNESS (CARGO – NON STANDARD CLAUSES)

 Notwithstanding the provisions of the Institute Clauses included herein by reference relating to unseaworthiness of the vessel or craft and unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject matter insured, the seaworthiness of the vessel or craft and fitness of the vessel craft conveyance or liftvan for the safe carriage of the subject matter insured is admitted as between the Assured and Underwriters

TRANSIT EXTENSION CLAUSE (CARGO – NON STANDARD CLAUSES)

Notwithstanding the limitations of the ‘Duration’ Clause of the Institute Cargo Clauses and Institute Strikes Clauses, Insurer hereon agree to hold covered at an additional premium to be agreed, any interest failing to arrive at consignee’s warehouse within the 60 days period in normal course of transit after completion of discharge from the overseas vessel due to circumstances beyond control of the Insured subject to notification of such delay at the earliest possible moment.
In respect of inland transit &/or storage cover, it absolutely exclude terrorism cover.

SUBROGATION CLAUSE (CARGO – NON STANDARD CLAUSES)

 The Assured shall at the request of the Insurer or their agents, assign and subrogate to the Insurer at time of payment and to an amount not exceeding the sum paid by the Insurer all their rights and claims against others and permit suit to be brought in the Insured’s name but a the Insurer’s expense, the Insured further agrees to render all reasonable assistance in the prosecution of said suit or suits.

SECONDHAND MACHINERY REPLACEMENT CLAUSE (CARGO – NON STANDARD CLAUSES)

In the event of a claim for loss or damage to any part or parts of the interest insured in consequence of a peril covered hereunder, it is agreed that the amount recoverable shall not exceed such proportion of the cost of replacement of the parts loss or damaged as the insured value bears to the value of a new item, plus additional charges for duty, forwarding and refitting the new part or parts if incurred.

Provided always that in no case shall liability of the Underwriters exceed the insured value of the complete article.

SORTING CHARGES CLAUSE (CARGO – NON STANDARD CLAUSES)

it is agreed that, in the event of the Insured &/or consignee complying with the surveyor;s instructions to separate shipping packages showing signs of external damage from the sound packages to ascertain possible loss arising from a peril insured against, such expenses as approved by the surveyor shall be for the account of Insurer even though a claim may not subsequently result hereunder.

RETURNED SHIPMENTS CLAUSE (CARGO – NON STANDARD CLAUSES)

In the event of shipments insured under this policy being returned for any reason, Underwriters hereon agree to hold covered such shipments, continuously hereunder, including whilst in warehouse or elsewhere until finally disposed of by the Assured.

Reports of such returned shipments to be made to the Underwriters by the Assured as soon as practicable after they have knowledge of same.

These risks are held covered at rates to be agreed, subject to Underwriter’s agreement regarding the overall extension period required and subject to individual details of each case as may arise.

In those cases where returned goods were not insured under this policy for the outward voyage or where cover under this policy has not been continuous, it is agreed that shipments are held covered at rates to be agreed, subject to the Institute Cargo Clauses (B) 1.1.82 including heavy weather damage and loss overboard and the Institute War and Strikes Clauses. Cover is also automatically extended to include the Institute Malicious Damage Clause without additional premium.

REPLACEMENTS BY AIR CLAUSE(CARGO – NON STANDARD CLAUSES)

It is agreed that where there is loss or damage which is the subject of a claim hereunder and the Assured consider it necessary to forward replacements by Air, Underwriters will pay the reasonable extra costs so involved, notwithstanding that the original consignment was not despatched by Air.

REPACKING COST CLAUSE (CARGO – NON STANDARD CLAUSES)


It is agreed that, in the event of the original shipping packages arriving at the final destination in a visibly damaged condition arising from a peril insured against, the costs of replacing such packages shall be for the account of Underwriters in those instances where it is an established custom of the Assured’s &/or consignee’s trade to deliver the goods to the final customer’s premises in the original shipping packages.

POSTAL SENDING CLAUSE (CARGO – NON STANDARD CLAUSES)

Risks to commence from the time packages leave the premises of the Assured and/or storage warehouse and to continue until delivery by the postal authorities to the addressee or his / their representatives and to include cover for the return journey if for reasons beyond the control of the Assured the goods are returned by the postal authorities.

Subject to Institute Cargo Clauses (A) or (Air) in so far as is applicable.

PACKING CLAUSE (CARGO – NON STANDARD CLAUSES)

In the event of a claim being made for loss or damage which is alleged to be caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured, Underwriters hereby agree that they will not use such alleged insufficiency or unsuitability as a defence against the claim in any case where the packing or preparation was carried out by a party other than the Named Assured and the insufficiency or unsuitability arose entirely without the Name Assured’s privity or knowledge. For the purpose of this clause ‘packing’ shall be deemed to include stowage in a container &/or other similar inter-modal methods of unit load.

The Assured agrees to assist Underwriters in all respects to pursue rights of recovery against sellers &/or other responsible third parties.

The above agreement is not to interfere with the Underwriters’ rights of subrogation against packers &/or their Underwriters.

Notwithstanding the above, it is further agreed that where packing or preparation is undertaken by the Assured, Underwriters accept such packing or preparation as sufficient or suitable to protect the interest insured against loss or damage and further agreed to waive rights of subrogation against the Insured, provided such packing is customary for the trade or subject-matter insured or in accordance with established packing practices of the Insured.

PAIRS AND SETS CLAUSE (CARGO – NON STANDARD CLAUSES)


Where any insured item consists of articles in a pair or set this policy is not to pay more than the value of any particular part or parts which may be lost without reference to any special values which such article or articles may have as part of such pair or set, nor more than a proportionate part of such pair or set

LOSS PAYEE CLAUSE (CARGO – NON STANDARD CLAUSES)

Agreed that any Bank and/or Mortgagee and/or Lender and/or any other party whom the Assured give instructions to include hereunder as a Loss Payee, are incorporated into this Policy as a Loss Payee, for their respective rights and interest but only so far as any losses which may be recoverable under the terms, conditions and clauses of this Policy

INSOLVENCY EXCLUSION CLAUSE / Business Protection Clause (CARGO – NON STANDARD CLAUSES)



It is hereby agreed that the exclusion “loss damage or expense arising from insolvency or financial default of the owners, managers, charterers or operators of the vessel and/or aircraft” (incorporated in the Institute Clauses herein) is amended to read as follows:-


“In no case shall this insurance cover loss, damage or expense arising from insolvency or financial default of the owners, managers, charterers or operators of the vessel and/or aircraft where the Assured is unable to show that, prior to the loading of the subject-matter insured on board the vessel and/or aircraft, all reasonable practicable and prudent measures were taken by the Assured, their servants and agents, to establish the financial reliability of the party in default.”

This exclusion shall not apply where this insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract.”
