TRAVEL INSURANCE POLICY
THE INSURED having applied to the Company for
the insurance expressed herein and made a Proposal and Declaration which shall
be the basis of this contract and is deemed to be incorporated herein and
having paid or agreed to pay the Premium as consideration for the insurance.
THE COMPANY will subject to the terms
exceptions and conditions contained herein insure in the manner and to the
extent hereinafter provided.
SECTION
A – PERSONAL LUGGAGE
If the Insured Person’s personal luggage
shall be the lost or damaged during the Period of Insurance by any cause not
hereinafter excepted the Company will by payment or as its option by repair
replacement or reinstatement provide indemnity for such loss or damage up to
the Sum Insured stated in the Schedule provided always that no one article
shall be deemed of greater value than USD.
2,000.00 Or equivalent unless separately
specified in the Schedule.
SECTION
B – PERSONAL ACCIDENT
If the Insured Person shall during the Period
of Insurance sustain bodily injury caused by violent accidental external and
visible means which results directly and independently of any other cause in
death or disablement within twelve calendar months from the date of injury the
Company will pay the relevant sum in accordance with the following Table of

total benefit in respect of any one Insured Person shall not exceed the CAPITAL
SUM INSURED

the CAPITAL SUM INSURED exceed USD. 20,000 or equivalent any amount payable
under Benefit 4 shall be restricted to USD. 200 or equivalent per week
(iii)
death
shall not be presumed from the disappearance of an Insured Person
SECTION
C – MEDICAL AND OTHER EXPENSES DUE TO ACCIDENT
The Company will provide indemnity up to the
Sum Insured stated in the Schedule for the following expenses necessarily
incurred as a direct result of death bodily injury disease or illness of the
Insured Person occurring during the Period of Insurance.
(1) Medical Surgical and
Nursing fees hospital and nursing home charges including charges for emergency
dental treatment to relieve pain or where rendered necessary by bodily injury
(2) Additional accommodation and transport charges of the
Insured Person and of any relative or friend traveling with or to or remaining
with the Insured Person on medical advice
SECTION
D – PERSONAL LIABILITY
The Company will provide indemnity against
all sums which the Insured Person becomes legally liable to pay as damages in
respect of
(i)
accidental
bodily injury (including death or disease) to any person
(ii)
accidental
loss of or damage to property
occurring during the Period of Insurance.
The Company will also pay legal costs and
expenses recoverable by any claimant and all costs and expenses incurred with
the written consent of the Company.
The liability of the Company for all damages
payable arising out of one occurrence or series of occurrences consequent on
one original cause shall not exceed USD. 200,000 or equivalent.
EXCEPTIONS
TO SECTION A
The Company shall not be liable
(1) for the first USD. 50.00
or equivalent of each claim by each Insured Person
(2) for loss of or damage
to
(a) money coins postal or
money orders promissory notes cheques securities for money stock or share
certificates stamps of any kind tickets business books documents or papers or
petrol coupons
(b) any Personal Luggage
caused by theft or any attempt thereat while such Luggage is in or on any road
vehicle except while it is contained in a securely locked boot or contained in
any road vehicle of the “estate” type which is securely locked at all points of
access to the interior
(c) contact lenses or fragile
or brittle articles (other than lenses of cameras or binoculars or telescopes)
electronic or musical apparatus unless caused by fire or theft or accident to
the means of conveyance
(3) for loss or damage
directly or indirectly caused by or resulting from
(a) any process of
cleaning dyeing restoring altering or repairing wear and tear depreciation moth
vermin or insect atmospheric or climatic conditions
(b) delay confiscation or
detention by Customs or other Officials or Authorities
(c)
(i)
ionizing radiations or contamination by
radioactivity from any nuclear fuel or from any nuclear waste from the
combustion of nuclear fuel Solely for the purpose of this Exception combustion
shall include any self-sustaining process of nuclear fission
(ii) nuclear weapons
material
(4) for loss of or damage directly occasioned by pressure waves caused
by aircraft and other aerial devices traveling at sonic or supersonic speeds
EXCEPTIONS
TO SECTIONS B AND C
The Company shall not be liable in respect of
1. death bodily injury or
illness of an Insured Person
(a) who has attained the
age of 60 years at the time of making a Proposal for this Insurance
(b) sustained while
suffering from the effect or influence (temporary or otherwise) of alcohol or
drugs not prescribed by a qualified medical or dental practitioner venereal disease
or insanity
(c) consequent upon
i pregnancy or
childbirth or an Insured Person committing an unlawful act or willfully exposing
himself to danger (other than in an attempt to save human life) or intentional
self injury
ii engaging in winter or
professional sports rock climbing or mountaineering which requires the use of
ropes or guides pot-holing parachuting association football rugby football ice
hockey polo riding a motor cycle motor scooter or mechanically assisted pedal
cycle (whether as driver or passenger) steeple chasing big game hunting or
hunting other than on foot or racing other than on foot or the use of
underwater breathing apparatus
iii flying other than as a
passenger by recognized Air Lines on a regular Scheduled Service over
established air routes or in any fully licensed standard type multi-engine
aircraft operated by a recognized Air Charter Company
(d) resulting directly or
indirectly from any illness disease infirmity physical defect or condition
which existed at the time of the Insured making a Proposal for this Insurance
2. the first USD. 10 or
equivalent of each claim by each Insured Person (not applicable to Section B)
EXCEPTIONS
TO SECTION D
The Company shall not
provide indemnity for
(1) liability in respect
of
(a) bodily injury to (i)
the Insured Person or (ii) his employee arising out of and in the course of his
employment by the Insured Person
(b) loss of damage to
property belonging to or in the custody or control of the Insured Person
(2) liability arising from
(a) the pursuit of any
trade business or profession
(b) the ownership
occupation or use of any land or building (other than the temporary occupation
or use of any residence)
(c) the ownership
possession or use (other than use as a passenger having no right of control) of
mechanically propelled vehicles aircraft or watercraft (other than non-power
driven craft used on inland waterways).
(3) liability directly or
indirectly caused by or arising from or in consequence of or contributed to by
(a) ionizing radiations or
contamination by radioactivity from any nuclear fuel or from any nuclear waste
from the combustion of nuclear fuel Solely for the purpose of this Exception
combustion shall include any self-sustaining process of nuclear fission
(b) nuclear weapons
material
GENERAL
EXCEPTION TO ALL SECTIONS
The company shall not be liable for any
consequences of war invasion act of foreign enemy hostilities (whether war be
declared or not) civil war mutiny rebellion revolution insurrection military or
usurped power riot or civil commotion. In any claim or in any suit or other proceedings
where the Company alleges that by reason of this Exception any loss is not
covered by this Policy the burden of proving that such loss is covered shall be
upon the Insured.
CONDITIONS
(1) All ordinary and
reasonable precautions shall be taken to avoid injury loss or damage
(2) On the happening of
any event which may give rise to a claim under this Policy the Insured shall
(a) give immediate notice
to the Company and if property is lost or theft is suspected the police or
equivalent authority must be informed and all practical steps taken to recover
the property
(b) submit full
particulars of the claim in writing within 30 days of the event
(c) supply at his own
expense all reports certificate information and assistance reasonably required
(d) not abandon any
property to the Company
(3) Except for claims
under Section B the Company may at its own expense and for its own benefit take
proceedings in the name of the Insured to recover compensation or secure an
indemnity from any Third Party in respect of any compensation damage or expense
covered by this Policy. The Insured shall give to the Company all information
and assistance in connection with the claim and any proceedings as the Company
may require
(4) In the event of loss
or damage to any article insured by Section A forming part of a pair or set the
liability of the Company shall not exceed a proportionate part of the Sum
Insured on the pair or set
(5) Except for claims
under Section B if any loss damage or expense is the subject of any other
insurance the Company shall not be liable to pay except in respect of the
excess beyond the amount which would have been payable under such other
insurance had this policy not existed
(6) All differences
arising out of this Policy shall be referred to the arbitration of some person
to be appointed by both parties or if they cannot agree upon a single
arbitrator to the decision of two arbitrators one to be appointed in writing by
each party and in case of disagreement between the arbitrators to the decision
of an umpire who shall have been appointed in writing by the arbitrators before
entering on the reference and an award shall be a condition precedent to any
liability of the Company or any right of action against the Company
